Privacy Policy

The General Data Protection Regulation and other applicable regulations, PONS CONSULTORES DE LA PROPIEDAD INDUSTRIAL, S.A. and PONS PATENTES Y MARCAS INTERNACIONAL, (hereinafter, “PONS IP”, “the Controllers” or “the Controller”, indistinctly) informs the User (Data Subject) more extensively about the processing of their personal data on the website  www.ponsip.com/en ((hereinafter, “the website”).

2. Purpose of the Processing of the data subject’s personal data

A) Execute the services provided by PONS IP, in accordance with the contracted services, including, among others, legal advice on intellectual property matters; its judicial or extrajudicial defence; the application, transfer, levy, extinction, waiver or the performance on behalf of the client of any other administrative act related to registry proceedings in relation to intellectual property rights, including the filing of the relevant appeals in administrative proceedings; data protection, new technologies, advertising and research and public records.

B) Manage access to website content exclusively reserved for PONS IP Clients.

C) Perform or apply services of a pre-contractual nature upon request by the User (Data Subject).

D) Regarding the personal data of the User (Data Subject) processed as a result of accessing and using the website (cookies), to communicate more comfortably and quickly between the User and the website, or to authenticate or identify the User in the case of a registered User, or to remember the contracting processes of the registered User. E) Send of electronic marketing communications in connection with the activities and services offered by PONS IP.

F) Manage job offers and applications at PONS IP.

3. Processing Duration. Preservation of personal data.

In accordance with the principles of transparency, usefulness and limitation of the processing purpose, the personal data concerning the User (Data Subject) shall be kept, in general, for the time strictly necessary to fulfil each of the purposes foreseen plus, where appropriate, the periods of limitation for the enforcement of contractual or pre-contractual liabilities (referring to the specific case of the purpose foreseen above in items A), B) and C) of section 2).
In the cases provided for in items D) and E) of paragraph 2 above, the personal data shall be kept for as long as the data subject does not revoke their consent to the processing stated.
In the case provided for in item F) of section 2 above, personal data shall be kept for a maximum period of two (2) months from the reception of the curriculum vitae from the Data Subject, unless they authorise the preservation of their data for a longer period of time.

4. Personal data processing legitimacy

In the cases provided for in items A), B) and C) of section 2 above, the legal base that legitimises PONS IP to process the User’s personal data is the execution of the contract or pre-contractual actions, as provided for in Article 6.1.b) GDPR.
In the cases provided for in sections D), E) and F) of paragraph 2 above, the legal base that legitimises PONS IP to process the User’s personal data is their consent, as provided for in Article 6.1.a) GDPR.

5. Communication and international transfer of personal data

PONS IP shall not communicate the personal data processed to any third party, except at the express request of a court or as required by the authorities of Law Enforcement Agencies.
PONS IP may transfer your data internationally to countries whose level of protection is not the same as in the European Union. Specifically, to the extent required by the contract for the provision of services entered into with the Data Controller, your personal data may be transferred to countries such as China, Colombia and the United States of America, where PONS IP has commercial representation offices. In addition, as a consequence of the services requested by the Data Subject, it is possible and necessary for us to transfer their personal data to other intellectual property agencies or specialised law firms in order to fulfil the contractual or pre-contractual services agreed upon. The level of protection for personal data in these other countries where these agencies and law firms are located may not be the same as in the European Union.

6. Rights regarding the processing of personal data

The User (Data Subject) has the following rights regarding the processing of their personal data:

• Right to request access to personal data;
• Right to request its rectification or erasure;
• Right to request the limitation of their processing;
• Right to object to the processing;
• Right to the portability of the data concerned; and
• Right to withdraw consent at any time.

These rights can be exercised in several ways:
• By sending a written communication to the postal address of the Data Controller.
• By sending an e-mail to rgpd@ponsip.com.

Exercising the aforementioned rights shall be in accordance with the procedure provided for in the applicable regulations, whether the General Data Protection Regulation or the national legislation enacted on the occasion of its incorporation into our legal system.
Likewise, the User (Data Subject) may file a complaint with the Spanish Data Protection Agency through its website: www.aepd.es.
